November 3, 2010 - South Dakota voters approve law (Referred Law 12) to expand the state's smoking ban. The vote 61.7% YES and 35.3% NO.
The South Dakota legislature first passed a smoking ban bill back in 2009. Governor Mike Rounds signed the bill into law and it was to take effect on July 1st. But just days before the deadline a coalition of bars and gambling businesses gathered enough signatures to force a statewide vote.
Referred Law 12 adds to the 2002 smoking ban passed by the state legislature, extending the ban to bars, video lottery establishments and casinos in Deadwood, as well as the public areas and workplaces where smoking was already banned.
With the passing of Referred Law 12 South Dakota becomes the 29th state to pass a statewide smoking ban. The ban could take effect as soon as next Wednesday. Because it was a referred law and already passed by the state legislature it will go into effect almost immediately.
